Purpose

These terms and conditions apply whenever a contracting party (“the client”) uses services provided by The Training Practice.

 

Acceptance

These terms apply to the client’s use of any of The Training Practice’s services after The Training Practice has given the client a copy of these terms. Use of the Training Practice’s services by the client from then on means the client has accepted these terms and conditions.

 

Jurisdiction

The New Zealand courts shall have exclusive jurisdiction in any dispute between the client and the Training Practice.

 

Confidentiality

The Training Practice shall treat all information provided by the client about the client’s business as confidential. The client shall treat all information provided by The Training Practice in relation to training material as confidential, unless otherwise agreed.

 

Confirmation of Booking

A booking is confirmed once a specified date is selected. If the booking is in advance, between 3 –12 months, we will send a confirmation reminder three weeks prior.

 

Confirmation of Requirements

The client will confirm requirements no later than seven days before the event to the event:

  • numbers attending
  • any additional training requirements, including alterations to the training programme and materials.

The Training Practice will confirm the charges that will apply for any additional services. These may not have been previously advised to the client.

 

Cancellations

The following cancellation policy applies to both our public and in-house training programmes.

  • If the client cancels a confirmed booking 28 days before the event, the client will be required to pay 10% of the confirmed booking fee.
  • If the client cancels a confirmed booking 14 days before the event, the client will be required to pay 50% of the confirmed booking fee.
  • If the client cancels a confirmed booking seven days before event, the client will be required to pay 100% of the confirmed booking fee.

Please note: If any design or development work has been carried out prior to a cancellation, the client will be charged for this work.

 

Invoicing and Payment Terms

All invoices are to be paid within 14 days of the the invoice date (“the due date”). The client will also be liable for all legal and debt collection costs that The Training Practice may incur, including solicitor/client costs, in enforcing or attempting to enforce their rights under these terms.

 

Goods and Services Tax

All costs quoted to the client are exclusive of GST.
